Pursuant to Personal Data Protection Law no. 6698 (“Law”), Otokoç Otomotiv Ticaret ve Sanayi Anonim Şirketi (“Company”) acting with the title of data controller attaches great importance to protection of your personal data.

2.     Purpose of Data Processing

Your collected personal data can be processed under the personal data processing conditions stated in articles 5 and 6 of the Law and for following purposes including performing required works and conducting relevant business processes by our business departments to allow you to benefit from the products and services provided by our Company, performing required works and conducting relevant business processes by our business departments to perform the commercial activities conducted by our Company, and provision of legal, technical and commercial-business security of our Company and relevant persons who have business relations with our Company (“Purposes”):

• Creating, following or cancelling memberships related to products and services of our Company,  
• Executing vehicle spare part and accessory sales,
• Providing vehicle protection services,
• Performing after sales support services,
• Conducting accounting and finance processes,
• Performing financial risk assessments of customers,
• Receiving and evaluating requests and complaints,
• Planning and execution of customer relations management processes,
• Following and conducting legal procedures,
• Fulfilling official institution requests, 
• Conducting information safety processes,
• Performing inspection and ethical activities,
• Planning and executing customer satisfaction and corporate communication activities,
• Performing draw, campaign, contest, promotion or advertisement activities,
• Upon your consent, customizing of the products and services provided by our Company based on your favorites, habits of use and needs, and sending advertisements, promotions, campaigns and similar commercial electronic messages to your contact details within this scope,
• Upon your consent, processing your health data and providing after sales support services in the event of an accident.
   

3.     To whom and with what purpose the processed personal data can be transferred

Your collected personal data can be shared with our business/solution partners, suppliers, legally authorized public institutions and legally authorized natural persons within the frame of personal data processing conditions and purposes stated in article 8 of the Law for the performance of Purposes. You can find detailed information about the parties to which your personal data is transferred from the Policy.
 
Upon your explicit consent, your identity data, communication data, financial data and habits of use data can be shared with Emarsys eMarketing Systems AG located abroad via Emarsys İletişim Sistemleri Tic. Ltd. Şti. for this purpose of sending of commercial electronic messages such as advertisements, promotions, campaigns, etc. to your contact details for customization and recommendation of the products and services provided by Otokoç Otomotiv Ticaret ve Sanayi Anonim Şirketi based on my favorites, habits of use within the frame of personal data processing conditions and purposes stated in article 9 of the Law. Again, within the scope of your express consent, your health data can be shared with business/solution partners and suppliers for the purpose of providing after-sales support services in the event of an accident.
 

4.     Method and Legal Reason of Collecting Personal Data

Your personal data are collected by our Company via our website, mobile applications, social media accounts, e-mail in the event you contact with our Company within the scope of sales or provision of our products or services, and via physical cargo/mail, fax, personal interviews based on the legal reasons stated in articles 5 and 6 of the Law and stated below.

Based on the legal requirement for execution of legal liabilities of our Company;

• Fulfilling requests of official institutions,  

 
Based on the legal requirement for data processing for establishing, using or protecting a right;

• Receiving and evaluating requests and complaints,

 
Based on the legal requirement for data processing for rightful interests of the data controller, provided that it does not harm basic rights and freedoms of the relevant person;

• Customizing and recommending the products and services provided by our Company based on your favorites, habits of use and needs, and sending advertisements, promotions, campaigns and similar commercial electronic messages to your contact details within this scope, and sharing with Emarsys eMarketing Systems AG located abroad via Emarsys İletişim Sistemleri Tic. Ltd. Şti. for this purpose of sending of commercial electronic messages such as advertisements, promotions, campaigns, etc. to my contact details,
• Processing your health data and providing after sales support services in the event of an accident, and sharing your health data with business/solution partners and suppliers for the same purposes.
   

5.     Rights of Data Controller Listed in Article 11 of the Law

 As a personal data owner, we inform that you have the following rights in accordance with Article 11 of the Law:

• To learn as to whether personal data has been processed or not,
• To request information if your personal data has been processed,
• To learn the purpose of processing personal data and whether they are used in line with their purpose,
• To know about the third parties to whom personal data are transferred domestically or abroad,
• To request correction of the personal data processed incompletely or inaccurately and to request the provision of the information on the transaction performed under this scope to the third parties to whom the personal data are transferred,
• To request deletion or destruction of personal data in case the reasons necessitating their processing cease to exist, despite personal data has been processed in accordance with Law and relevant other law provisions, and to request notification of the operations made within this context to third parties to whom your personal data has been transferred,
• To object to consequences to her/his detriment arising from the analysis of the processed data exclusively via automatic systems,
• To request compensation for the damages in case s/he incurs damages due to unlawful processing of personal data.

 
You can inform our company about your applications related to the aforementioned rights by filling out the Data Controller Application Form you can access via the link www.otokocotomotiv.com.tr/veri_sahibi_basvuru_formu.pdf. Depending on the nature of your request, your applications will be concluded free of charge as soon as possible and within thirty days at the latest; however, if the transaction requires an additional cost, you may be requested with a charge according to the tariff to be determined by the Personal Data Protection Board.
